These Terms & Conditions ("Terms") govern your access to and use of www.gyanbatua.ai and related applications/services (collectively, the "Platform").
The Platform is owned and operated by Matrix Secure India Pvt. Ltd. (a Mobiloitte Group company) ("Company", "we", "us", "our").
By accessing or using the Platform, you agree to these Terms. If you do not agree, do not use the Platform.
1) About the Platform
Gyanbatua.ai is an AI-enabled learning and interview-preparation platform that helps users prepare for jobs, internships, and apprenticeship opportunities through assessments, learning-gap analysis, and personalized guidance.
2) Eligibility (13+ Only)
The Platform is intended for users aged 13 years and above.
If you are under 18, you may use the Platform only under the supervision of a parent or legal guardian who agrees to these Terms on your behalf and is responsible for your use.
If you are a parent/guardian allowing a minor to use the Platform, you represent that you have reviewed and accepted these Terms and consent to the collection and use of the minor's data as described in the Privacy Policy (once published).
Users under 13 are not permitted to use the Platform. If we learn a user is under 13, we may suspend/terminate the account and delete associated data.
3) Account Registration & Security
You may need an account to access certain features. You agree to provide accurate and complete information and keep it updated.
You are responsible for maintaining the confidentiality of your login credentials and for all activities under your account.
You must promptly notify us of any unauthorized use of your account.
4) Nature of Services; No Guarantee
The Platform provides:
- assessments and practice modules,
- AI-driven feedback and learning-gap identification,
- guidance and suggestions for interview preparation and skill improvement.
The Platform is for educational and informational purposes only. We do not guarantee employment, internships, apprenticeships, interview shortlisting, or outcomes.
5) AI Output Disclaimer
AI-generated outputs may be incomplete, inaccurate, outdated, biased, or unsuitable for your specific situation.
You are solely responsible for how you use the Platform's outputs and should independently verify information before relying on it (including for applications, submissions, or interviews).
The Platform is not a substitute for professional advice (including legal, financial, medical, or regulatory advice).
6) Acceptable Use
You agree not to:
- use the Platform for unlawful purposes or in violation of any law or regulation,
- upload, share, or use content you do not have the rights to,
- harass, abuse, defame, threaten, or harm others,
- attempt to reverse engineer, scrape, disrupt, overload, or compromise the Platform or its security,
- upload malware, bots, or harmful code,
- use the Platform to cheat in examinations or violate rules of recruiters/institutions,
- impersonate any person/entity or misrepresent affiliations.
We may suspend or terminate access for violations.
7) Minor Safety & Appropriate Use
Minors should use the Platform in a safe and age-appropriate manner and under parental/guardian supervision.
Do not share sensitive personal information in prompts or submissions (such as home address, passwords, bank/UPI details, or government ID numbers).
We may remove content or restrict features and may suspend accounts to protect minors and maintain platform safety.
8) User Content
"User Content" includes information or materials you submit through the Platform (e.g., resumes, answers, prompts, files, and profile information).
You retain ownership of your User Content.
You grant the Company a non-exclusive, worldwide, royalty-free license to host, store, process, reproduce, and display User Content only as necessary to operate, maintain, secure, improve, and provide the Platform and to comply with law.
You represent that you have all rights necessary to submit User Content and that it does not infringe third-party rights or violate law.
If you are a minor, your parent/guardian is responsible for the User Content you submit and for ensuring it is appropriate and lawful.
9) Intellectual Property
The Platform and all related intellectual property (including software, design, branding, text, graphics, and platform content, excluding User Content) are owned by or licensed to the Company and are protected by applicable laws. You may not copy, modify, distribute, sell, license, or create derivative works from the Platform except as expressly permitted by these Terms or by law.
10) Fees, Payments & Taxes
Certain features may be offered on a paid or subscription basis.
Prices, plan details, and inclusions will be shown at checkout or on the Platform before purchase.
Applicable taxes (including GST, if applicable) may be charged as per law.
If you purchase via third-party payment gateways or app stores, their terms may also apply.
Refunds/Cancellations: The Platform's refund and cancellation rules are governed by our Refund Policy, which will be published separately and/or presented at checkout. In the event of conflict, the Refund Policy shall apply for refund-related matters.
11) Third-Party Services
The Platform may include links to or integrations with third-party websites or services. We do not control and are not responsible for third-party content, policies, or practices. Your use of third-party services is at your own risk and subject to their terms.
12) Privacy
Our Privacy Policy (to be published separately) explains how we collect, use, store, and share personal data, including for users aged 13–17. Once published, the Privacy Policy will be available on the Platform and will form part of these Terms by reference.
13) Availability, Updates & Changes
We may update, modify, suspend, or discontinue any part of the Platform at any time, including features, content, pricing, and availability. We do not guarantee uninterrupted or error-free operation.
14) Suspension & Termination
We may suspend or terminate your access to the Platform, with or without notice, if:
- you violate these Terms,
- it is required to comply with law or lawful requests, or
- it is necessary for security or operational reasons.
You may stop using the Platform at any time.
15) Disclaimers
To the maximum extent permitted by law, the Platform is provided on an "AS IS" and "AS AVAILABLE" basis. We disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, accuracy, and non-infringement.
16) Limitation of Liability
To the maximum extent permitted by law:
We are not liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or any loss of profits, data, goodwill, or business opportunity.
Our total liability for any claim related to the Platform shall not exceed the total amount paid by you to the Company in the 3 months immediately preceding the event giving rise to the claim, or INR 1,000, whichever is higher.
17) Indemnity
You agree to indemnify and hold harmless the Company, its directors, officers, employees, and affiliates from any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to:
- your use of the Platform,
- your User Content,
- your breach of these Terms or applicable law.
18) Governing Law & Jurisdiction
These Terms are governed by the laws of India. Subject to applicable law, courts at Saket City Courts, New Delhi shall have exclusive jurisdiction over any disputes arising out of or relating to these Terms or the Platform.
19) Changes to These Terms
We may update these Terms from time to time. The updated version will be posted on this page with a revised effective date. Your continued use of the Platform after changes means you accept the updated Terms.
